LIKEWIZE SERVICES UK LIMITED Terms and Conditions

This page tells you information about us and the legal terms and conditions (the “Terms”) on which you trade-in your mobile phone (the “Products”) with LIKEWIZE SERVICES UK LIMITED (“Likewize”) via its platform (the “Back-End Platform” or “Site”), which interfaces with the Argos Website for processing the purchase and return of your Product.

By entering the details of your Product, accepting the Terms and sending it to Likewize, you instruct Likewize to evaluate and purchase the Product from you. Payment (if any) will be made via bank transfer.

References to money or payment refer to the value Likewize determines your Product to be worth.

These Terms are a contract between you and Likewize, company number 08401611, registered at Crewe Logistics Park, Jack Mills Way, Shavington, Crewe, CW2 5XF.

You must agree to these Terms to trade-in a Product. Print or save them for your records.

Check these Terms regularly. Last updated: 10th April 2019.

1. Information about us

1.1 We operate the Site and service. VAT number: GB 824 2965 18. Contact: Unit 2, Crewe Logistics Park, Jack Mills Way, Shavington, Crewe, CW2 5XF. Phone: 0344 412 2986. Email: argostradein.uk@likewize.com.

1.2 Likewize operates independently from Argos. Argos is not responsible for your trade-in with us.

1.3 By using this service, you release Argos and its representatives from any claims or disputes relating to the trade-in.

2. The Site
  • 2.1 Content may change and may be out of date. No guarantees are made about accuracy.
  • 2.2 The Site is free, but may be unavailable or interrupted without notice.
  • 2.3 You are responsible for arranging access to the Site.
  • 2.4 Keep login details confidential.
  • 2.5 We may disable access if you violate these Terms.
  • 2.6 The Site is not professional advice. Seek appropriate guidance before acting on any content.
  • 2.7 Use your own virus protection software.
  • 2.8 Do not attempt to harm or access the Site unlawfully. Breaches may be criminal offences.
  • 2.9 We are not responsible for third-party websites linked from the Site.
3. How we use your personal information

3.1 We collect your contact, bank, and Product details solely to process your trade-in. Data is handled in line with our privacy policy.

Please remove your data from the Product
  • a. Remove SIM and memory cards. We’re not responsible if left in the device.
  • b. Delete all personal data and reset to factory settings.
    • i. Apple: Follow Apple guidance. Disable “Find My iPhone”.
    • ii. Other brands: Follow manufacturer’s instructions.
    • iii. Resetting may not delete everything. We are not liable for leftover data.
  • c. Devices with data will be rejected and returned.
  • d. Disable any security locks or tracking tools. If not, the device may be valued at zero.

3.3 You release us from any responsibility for data or SIM left in the device. Once sold, we may resell the Product to a third party.

3.4 Back up all data you want to keep before sending your Product.

3.5 You are solely responsible for backing up and deleting your data. We do not offer data recovery.

3.6 If data is visible on receipt, Likewize will return the Product.

3.7 Once erased and reset, no data recovery is possible. Backup is strongly advised.

4. If you are a Consumer

This clause 4 only applies if you are a Consumer.

4.1 For the purposes of these Terms, "Consumer" means an individual who is acting for purposes which are outside his or her business, as defined by the Consumer Rights Act 2015. Subject to clause 6 of these terms and conditions, if you are a Consumer, by trading-in Products via the Site you warrant that:

  • You are at least 18 years old or, if under 18, have parental/guardian consent.
  • You are the sole owner or authorized to trade-in, with no liens/encumbrances.
  • The Product is not counterfeit, stolen or fraudulent.
  • You are not infringing IP rights by trading-in the Product.
  • You are UK-resident and using the Site from the UK.
  • You can legally enter into a binding contract.

4.2 These terms shall not affect any statutory consumer rights.

5. If you are a business customer

This clause 5 only applies if you are a business customer.

5.1 Subject to clause 6, by trading-in Products via the Site, you warrant that:

  • You are based in the UK and accessing the Site from there.
  • You are the sole owner or authorized to trade-in, with no liens/encumbrances.
  • The Product is not counterfeit, stolen or fraudulent.
  • You are not infringing IP rights by trading-in the Product.
  • You have authority to bind your business.

5.2 These Terms and referenced documents form the entire agreement.

5.3 You acknowledge no reliance on statements not in these Terms.

5.4 No claims for misrepresentation may be based on statements outside this Contract.

6. Excluded customers

Product dealers, stockists, or specialist retailers, resellers or distributors are excluded from offers unless otherwise agreed in writing by a director of Likewize.

7. Our right to vary these Terms

7.1 We may amend these Terms from time to time. See top of page for updates.

7.2 The Terms in force at the time of your trade-in will apply.

7.3 We may revise Terms to reflect:

  • Changes in laws or regulations.
  • Changes in our business practice.

7.4 We will notify you of changes that affect your order and offer a right to cancel.

8. Product trade-in process

8.1 The Site will guide you through steps and allow error correction before submission.

9. Valuing your Product

9.1 Accurately describe your Product to receive an Original Quotation.

9.2 “Full Working Condition” means:

  • Complete, with no missing or damaged parts.
  • Fully functional, no PIN locks, all features working.
  • Clear, intact display with no cracks or fading.
  • No liquid damage or signs of it.
  • Flip/slider mechanisms work properly.

9.3 Non-fully working Products may be rejected or revalued at our discretion.

9.4 Activation-locked Products will not be accepted.

9.5 Contact us if unsure about the Product’s condition.

9.6 Accessories may be accepted but don’t affect value.

9.7 After receipt, an Inspection may lead to a Revised Quotation.

9.8 Send Products within 14 days of receiving packaging to secure Original Quotation.

10. Lost, Blocked, Stolen and Fake Products

10.1 Definitions:

  • "Lost, Blocked or Stolen": listed in CheckMEND databases.
  • "Fake": Counterfeit goods violating IP rights.

10.2 No payment for such Products.

10.3 Fraud is reported and funds reclaimed if identified within 3 months.

10.4 Such Products may not be returned unless legally required.

10.5 No payment for products from Prepay Box Breaking schemes.

11. Inspection and Revised Quotation

11.1 We inspect Products on arrival to verify condition and match description.

11.2 If all matches, payment made within 72 hours.

11.3 If not, a Revised Quotation is issued.

11.4 You have 14 days to accept it. No response = deemed acceptance and payment made.

11.5 Products can’t be returned after 14 days from Revised Quotation issuance.

11.6 Unrequested accessories will not be returned.

12. How the Contract is formed between you and us

12.1 Nothing on the Site is an offer by us to buy or sell.

12.2 Sending Products is Your Offer to sell.

12.3 The Contract is formed when:

  • We pay the Original Quotation.
  • We pay the Revised Quotation after acceptance.
  • You don’t respond to a Revised Quotation in 14 days and we pay that amount.
13. Payments

13.1 The final purchase price payable by Likewize for the sale of your used Product to us will be determined after we complete the Inspection of your Product, subject to these Terms.

13.2 If your Product is accepted by us following Inspection we will pay the Original Quotation to you within 72 hours.

13.3 If we offer a Revised Quotation we will pay the Revised Quotation to you within 72 hours of your acceptance of it.

13.4 If you fail to respond to our Revised Quotation by either accepting or rejecting it within 14 days we will pay the Revised Quotation to you within 72 hours of the expiry of the 14 days.

13.5 All quotations and payments include VAT (as applicable).

13.6 We will make the payment to your bank details provided to Likewize. Once funds are transmitted, Likewize has fulfilled its obligation. Ensure your details are correct, as Likewize is not liable for errors.

14. Title and Risk in Products

14.1 Title passes to us upon acceptance of the final purchase price, and you disclaim any further rights in the Product.

14.2 Risk passes to us once the Product is received via your courier.

14.3 While in transit, you must:

  • Package the product securely.
  • Provide a tracking number if requested.
  • Our liability is limited to £100 per package.
  • We are not liable for non-compliance with these conditions.

14.4 You may use your own packaging and will receive a free return label.

15. Our liability if you are a business customer

This clause only applies to business customers.

15.1 Nothing in these Terms limits our liability for:

  • Death or injury from negligence
  • Fraud
  • Other non-excludable liabilities

15.2 Subject to above, Likewize and affiliates are not liable for:

  • Loss of profits, sales, data, opportunities, savings, or goodwill
  • Indirect or consequential losses

15.3 Our total liability is limited to the Original Quotation.

15.4 We exclude implied warranties to the fullest extent permitted by law.

16. Our liability if you are a Consumer

This clause only applies to Consumers.

16.1 We are responsible for foreseeable loss or damage from our breach or negligence.

16.2 We do not exclude liability for:

  • Death or injury from negligence
  • Fraud
  • Other liabilities that cannot be excluded by law

16.3 We are not liable for loss of business or profit.

17. Indemnity

You agree to indemnify Likewize for any claims arising from breaches of these Terms or obligations under a Contract.

18. Events Outside Our Control

18.1 We are not liable for failure to perform due to Events Outside Our Control.

18.2 These events include but are not limited to natural disasters, war, terrorism, or failure of public systems.

18.3 In such cases:

  • We will notify you promptly
  • Our obligations are suspended during the event

18.4 You may cancel after 30 days and must return any received funds or items.

19. Communications Between Us

19.1 "In writing" includes email.

19.3 Business Customers: Same contact details. Notices must be delivered via mail or email. Proof of delivery is required.

19.4 Legal service documents are excluded from this clause.

20. Intellectual Property Rights

20.1 All content on the site is owned or licensed by us and protected by law.

20.2 You may print or download for personal use.

20.3 You must not alter or use content without permission.

20.4 Authors must be credited.

20.5 Commercial use requires a license.

20.6 Unauthorized use will terminate your rights and you must destroy all copies.

21. Other Important Terms

21.1 We may transfer our rights to another entity.

21.2 You need our consent to transfer your rights.

21.3 No third party has rights under this Contract.

21.4 If any term is found unlawful, the rest remain valid.

21.5 Failure to enforce rights doesn't waive them.

21.6 Governing Law:

  • a. English law applies.
  • b. Disputes will be settled in England and Wales courts.
22. Terms and Conditions – Enhanced Trade-In Offer

Have you purchased a qualifying device as part of our Enhanced Trade-In activity?

You can claim enhanced Trade-In value when you purchase a qualifying device - please see “Qualifying Purchases Data” below for details.

If you purchase a qualifying device from Argos, during the qualifying period you will qualify for an enhanced trade in value when you trade in your phone with Argos.

Claim your enhanced trade in value using these easy steps:
  1. Purchase your new Qualifying device from Argos
  2. Place your trade-in order here before the promo claims received by date (see table below).
  3. Enter your promotional voucher code when you trade in your old device
  4. Your voucher code is the IMEI of the new device you have purchased. You can find this by typing in *#06# onto your device. This will give you a 15-digit code – this is your promotion code. If there are 2 IMEIs, use the first one.
  5. Complete the Trade-In transaction & we will send you a device pack – return this to us, we will inspect your device and send payment including the enhanced trade-in amount.

These terms and conditions govern this offer which you must accept to participate. Please read the following Terms carefully and keep a copy for your information.

Eligible customers who make a qualifying purchase and then trade in an eligible old device with Argos Trade In using the promotional code from their eligible purchase will receive an enhanced trade in value in addition to the amount of the Argos trade in for their device.

The enhanced trade-in value will be processed and paid in accordance with Argos Trade In standard terms and conditions.

One offer per participant. Offer is not transferrable. No cash or other alternatives.

Eligibility and Participation

This offer is open to Argos customers who make a qualifying purchase as set out above within the qualifying period.

Qualifying purchases that are returned within the Change Your Mind period, or purchased through a third-party distributor, are excluded and will not qualify for this offer. The enhanced value will be forfeited.

To participate, an eligible customer with a qualifying purchase should use the IMEI of their new handset as their promotional code. This code will be activated 30 days from purchase and can be obtained by dialling *#06# on the new device.

All unique promotional codes should be entered during the checkout on https://www.argos-tradein.co.uk. Codes not entered at the point of order cannot be corrected and the enhanced trade-in will not be paid.

Promotional Period

All promotional dates are outlined in the Qualifying Purchase Data above. Any orders received after these dates will not receive the enhanced trade-in value.

Eligible Trade-In Condition

Any Trade-In Device used to claim in this promotion must:

  • Be owned by the participant making the claim
  • Include its battery within the casing and not have any missing parts
  • Be complete and not crushed, bent in half or liquid-damaged
  • Not be PIN locked or have ‘Activation Lock’ or 'Google Lock' activated
  • Not be ‘jail-broken’ or similar and must not have altered firmware
  • Meet the manufacturer’s original UK specifications
  • Not be personalised with any custom engraving
  • Have a trade-in value
Eligible Trade-In Devices
